Abstract :
The integration of generative artificial intelligence into the creation of visual artworks for smart urban spaces transforms contemporary urban aesthetics while introducing profound cultural and legal dilemmas. This study examines how generative AI operates as both a creative tool and a regulatory challenge within smart city visual arts. A systematic literature review was conducted across four academic databases (Google Scholar, Scopus, ACM Digital Library, Springer) using predefined keywords. Additionally, legal documents including national legislation, court rulings, and international regulations were retrieved from official sources. Art project documentation was obtained from institutional websites and professional art news platforms. A total of 32 peer-reviewed articles, 8 legal documents, and 6 art project reports published between 2024 and 2026 were analyzed using thematic analysis. Key tensions identified include the erosion of traditional artistic authorship, the risk of algorithmic cultural homogenization, and the inadequacy of current copyright laws for AI-generated public art. While generative AI enables dynamic, participatory, and adaptive art installations, it simultaneously challenges cultural authenticity and raises unresolved questions of legal liability and ownership. The study concludes by proposing a preliminary conceptual framework adapted to the Iranian context.
