Abstract :
The purpose of this article is to examine the challenges of preventing several drug institutions according to the crime prevention law. At the beginning of legislation on drug offenses, the legislator s approach to punishment and suppression in this regard, and since 1997, with the amendment of the Counter Narcotics Law, and the adoption of Article 33, the legislature s attitude and approach due to undesirable consequences of the criminal justice system, On impudence and reactive actions, and moved toward action and non-criminal measures. In other words, by ratifying Articles 33 and 34 of the Law on the Amendments to the Law on Narcotics, the prevention of which, in its conception, ended with a multidimensional and multidimensional approach to the drugs and psychoanalysis and the resulting offenses. Today, we will face criminal and non-criminal crime in the field of drug offenses. The criminal law of the legislator in the Counter Narcotics Law is always based on repression, severity of punishment, and disproportion in the manner in which the punishment is determined by the amount of social punishment, the perpetrator s personality, human dignity, the type of crime, and human rights standards that are proportionate to the criteria of the punishment. The attention is not enough. And it should be said that the criminal policy based on the use of capital punishment and long term imprisonment in addition to the lack of effective, unfair and unlike human dignity is due to the reluctance of judges to issue such sentences and to try to resort to legal or even occasional Illegal and also defective or non-performing of the majority of them in different ways is a clear explanation for the claim that severe and repressive punishments are not lucky for the criminal justice policy and therefore the penal policy of the authorities based on suppression and severity of punishment in terms of exclusion from moderation and proportionality In practice, you have been neutralized Success is not expected to follow. The results of many studies indicate that, along with punishments and deterrent roles in administering punishment at the community level, the use of non-criminological strategies to reduce crime should also be considered, which should be the general policies of the anti-narcotics system based on Participatory criminal policy and a multi-institutional approach to the use of all governmental and non-governmental facilities as well as the sharing of the community in the crime prevention process. Unfortunately, people s participation in preventing drug offenses and their consumption in society is currently low, while drugs are a major problem that must be resolved with public participation and a sense of universal responsibility, and everyone is thinking about eliminating this problem. Social participation and participate in this. Without the participation of the people and their responsibility, this problem will not be solved. Unofficial social control should be expanded by the people so that the perpetrators of the drug do not feel safe anywhere and then can be hoped for by the efforts of government officials that the spread of narcotics in the society becomes dim. Participation of the people requires informing and preparing the background. This information should be direct and indirect. Drug offenses, including those related to the smuggling and supply process, or the use of and addiction, are not offenses and sins that are defined in jurisprudential and Islamic laws for them, and the legislator can, according to The characteristics of the perpetrator, the national and international circumstances, the requirements of time and the values of the social culture, for the purpose of reforming the perpetrator and learning others, prescribe punitive and preventive punishments, even on the basis of restorative justice. On the one hand, the overall policies of the anti-narcotics system are based on participatory criminal policy and a multi-institutional approach to utilizing all governmental and non-governmental facilities, as well as the sharing of the public s profile in the crime prevention process. On the other hand, the preparation of a comprehensive bill for the comprehensive struggle against narcotics involves a macro- and multi-factor approach. A strategy in which all available capacities and capabilities, whether formal or informal, are used to achieve a common goal. And take advantage of citizen participation and their role. It is in the interest of society to prevent crime, in principle, it is not a criminal offense. Yet, with the indisputable occurrence of crime, there must be some barriers to the crime caused by the crime, in the end, the extent to which the crime is more in the interest of the community. Contradictions should be more severe barriers. A good blessing and deprivation of it and in fact a pleasure and stimulus of human behavior. Therefore, deprivation of liberty or anticipation of imprisonment and exile, seizure and confiscation of property, cash penalty, cancellation of employment license and holiday Institution and deprivation of social rights to the perpetrators of drug offenses L and is effective. In addition, the legislator can, by combating the effective factors in committing a crime, by raising the level of culture and living standards of the people and combating the economic, social and medical factors of committing a crime, such as poverty and unemployment, a deficiency in education or alcohol and Drug beliefs play a major role by regulating appropriate laws in preventing and preventing these crimes.
